The Initial Application
You should file your initial application for Social Security Disability benefits as soon as you become disabled. When completing this document, you will provide detailed information about your work history and your medical history. You will provide information about doctor visits and medicine you have taken related to your disability. You will sign a release form so that the Social Security office can speak with your doctor and collect your medical records.
The SSA may require you to undergo a medical examination at no cost to you.
Reconsiderations and Appeals
In the event that your initial application is rejected, don’t give up. Almost 90% of all claims are rejected at this stage. If your application has been rejected, you have 60 days to initiate a Request for Reconsideration. If your reconsideration is denied, you can appeal again and request a hearing before an Administrative Law Judge (ALJ).
If the ALJ rejects your claim, you can request that the ALJ’s decision be reviewed by the Appeals Council. The Appeals Council will either accept or deny your application, or send your application back to the ALJ for further consideration. If you disagree with the decision of the Appeals Council, you may file a lawsuit in federal court.
