& Settlements for Our Clients
Cleveland Brain Injury Lawyer
A 47 year old woman was injured when another car actually landed on top of her vehicle, crushing the roof with her under it. Miraculously, she appeared uninjured when freed from her crushed car. But over time, her injuries emerged as she was suddenly found to be “too slow” at work, where she had been lightening quick before her accident. Based upon our discussions with her, she was referred to a neurologist for evaluation, followed by a neuropsychologist, a vocational expert and an economist. The Cleveland brain injury lawyers at Rubin Guttman & Associates proved that she had suffered a traumatic brain injury and would suffer loss of income over her lifetime. The result: a settlement of over $675,000.00
A teenage girl went through the windshield of a car, causing massive traumatic brain injury as well as substantial disfigurement and the need for several surgeries. In addition to her physical injuries, we were able to prove that she would suffer cognitive difficulties throughout her life. Today her life is made easier because of a $1,875,000 settlement Rubin Guttman & Associates obtained , which will pay her over $11,000,000 over the course of her life.
And these are just two examples of the results Rubin Guttman & Associates has obtained as brain injury lawyers in the Cleveland area.
Some of the most serious injuries our clients suffer are traumatic brain injuries. These injuries are sometimes called “closed head injuries” when the skull has not been penetrated or broken . Or the injury may be the result of a skull fracture or a penetrating wound to the head. Traumatic brain injury is an injury to the brain caused by a blow or other external force (such as whiplash) which may produce symptoms such as an altered state of consciousness or changes in cognitive, physical, or even emotional functioning . People who are injured in an accident sometimes strike their heads or don’t even realize that they have done so. They may suffer such severe whiplash that the brain is effectively slammed in to the inside of the skull, causing injury. There is no visible bruise and they don’t even necessarily report hurting their head to the emergency room or to their doctor. Or they may experience some dizziness, headache or double vision, but may not even recognize that the symptoms are related to their accident. Sometimes they don’t even realize that they are “different” since the accident and it is family, friends or co-workers who see the difference in their behavior.
But tiny blood vessels may have been broken on impact causing bleeding ( hemorrhage) and the formation of what is known as a subdural hematoma, which can only be seen with an MRI or other advanced diagnostic tools. And this is only one example of a traumatic brain injury. Because their impact is not always apparent very early on, traumatic brain injuries are often overlooked in an emergency room, especially when the symptoms are not yet severe, but they can be a true medical emergency. It has been said that each year over 80,000 Americans experience long term disability as a result of traumatic brain injury and more than 50,000 people die of TBI. Prompt diagnosis and treatment are critical.
As Cleveland brain injury attorneys, Rubin Guttman & Associates has a great deal of experience in representing head injury victims . We will ask you about complaints and problems that emergency room physicians or doctors who specialize in orthopedics or general medicine may not have focused on. Over the course of time, as we visit with you after an accident, we will discuss with you in detail whether you are experiencing any problems with focus, balance, stamina, dizziness , speech or changes in your math skills or abilities at work. And if you tell us that you are, we will suggest that you see your doctor and a neurologist for a full evaluation. If you are found to have a traumatic brain injury we may also suggest an appointment with a neuropsychologist . A neuropsychologist is a professional with specialized training in diagnosing and treating problems which occur at the intersection between psychology and physical injury and they can be uniquely beneficial in diagnosing traumatic brain injury. We will then have a vocational expert evaluate how your employment may have been affected and hire an economist to determine the value of your economic and wage loss over time. At Rubin Guttman & Associates we are experienced brain injury attorneys who have represented Cleveland victims for over 30 years. And while we are certainly not doctors and do not make diagnoses, we help our clients get evaluated and get appropriate recovery for brain injuries suffered in an accident by referring you to the appropriate medical and neuropsychological professionals. At Rubin Guttman & Associates, we will always take the time to discover any injury you may have suffered, even if it’s not readily visible. That’s why we have recovered millions of dollars for our seriously injured clients and why we make a difference in our clients’ lives.
